In addition to these documents, we also show in-app notices that provide you more information about our products and services.
Transparency is one of our core values at The Pal. We believe there shouldnât be any surprises about the data we collect and how we use it â thatâs why weâre upfront with how we process it. For example, we process your information to provide you a more personalized experience, including to show you content and information that is most relevant to your experience, as well as more relevant advertisements. Understanding your interests and preferences help us provide a better product experience.
Furthermore, we believe a personalized experience should not come at the expense of your privacy. Just like in real life, there are some moments you want to share privately with your close friends, and others that you want to share publicly. Thatâs why from day one our philosophy has been to delete content by default and to give The Palchatters control by providing the tools that allow them to decide what happens with their content, like who to share it with or when to save it.
This Policy covers our The Pal app as well as our other products, services, and features, such as Emoji, Spectacles, and our advertising and commerce initiatives. When you read "Services" in this Policy, weâre talking about all of them. Also, if you see us refer to our "Terms," we mean the Terms of Service that you agree to when you sign up for our Services. Finally, if you see the term "The Palchatter" we are often using that as shorthand for any user of our Services.
Letâs get started with the controls you have over your information:
1. Control Over Your Information
Control over your information and settings is a core part of The Pal experience. Here, we give you more details on the types of settings that are available, link out to our data download tool, and provide instructions on how to delete data or your account.
We want you to be in control of your information, so we provide you with a range of tools, including:
Access and update your information. You can access and edit most of your basic account information right in our Services. Just navigate to your settings and you will see the options available to you.
Delete your information. If you want to delete your account, learn how here. You can also delete some information within our Services, like content youâve saved to Memories, content youâve shared with My AI, Spotlight submissions, and more.
Control who can see your content. Weâve built a number of tools that let you choose who you share your content with. In some cases you may want to share content with your friends, and in other instances you may want to share it with the public. To learn more, go here.
Control who can contact you. The Pal is intended for close friends and family, thatâs why weâve built controls that help you decide who can contact you. If you receive unwanted communications, you can always block and report that person. Go here to learn more.
Change your permissions. In most cases, you can change your permissions at any time. For example, if you provided access to your phone contacts to make friending easier, you can change that later on in your settings. Of course, if you do that, certain features and Services, like finding friends in your contact book, wonât work.
Opt out of promotional messages. You have the option to opt out or unsubscribe from promotional emails and messages sent by SMS or other messaging platforms. To do so, just follow the instructions in the message like an unsubscribe link or similar functionality.
Download your data. You can use our Download My Data tool to get a copy of information that may not be available in The Pal in a portable format, so you can move it or store it wherever you want.
Object to processing. Depending on where you live and the particular data we are processing, you may have the right to object to our processing of that information. This gets a bit technical, so weâve explained it in more detail here.
Set advertising preferences. We try to show you ads that we think will be relevant to your interests, but if youâd like to have a less personalized experience, you can change your advertising settings in The Pal app. Learn more here.
2. Information We Collect
This section provides you with details on what information we collect. Weâve organized this in a few categories: information you provide to us, information we generate based on your use of our Services, and information we receive from others. Sometimes, we may also collect additional information, with your permission.â¨When you use our Services, such as The Pal, we collect information you provide to us, generate information when you use our Services, and in some cases receive data from others. Letâs break these down in more detail.
3. Information You Provide
Many of our Services require you to set up an account. To do this, we ask you to provide us with account details (information about you, like your name, username, email address, birthday, and phone number). When you set up your profile, youâll also provide us with profile details (like your Emoji and profile picture). If you use our commerce products to buy something, like those latest sneakers, we may ask you for payment and related information (like your physical address, so we can ship the product to you, payment information, so we can process the payment, and transaction history). Of course, youâll also provide us with the information you send through or save within our Services. We consider some of this information to be private content and communications (like The Pals and Chats with friends, My Story set to Friends, Private Stories, voice and video calls, and content that is saved in My Eyes Only). On the other end of the spectrum, some of the information you send through or save within our Services may be public content that is accessible to everyone (such as Public Story content, including My Story set to Everyone, Shared Stories, and Community Stories, Spotlight or The Pal Map submissions, and Public Profile information). Keep in mind that The Palers who view your The Pals, Chats, and any other content, can always screenshot that content, save it, or copy it outside The Pal app. So please donât send messages or share content that you wouldnât want someone to save or share. Lastly, when you contact Support (content and communications shared with Support) or our Safety team, or communicate with us in any other way, including through our research efforts (like responses to surveys, consumer panels, or other research questions) weâll collect whatever information you provide or that we need to resolve your question.
4. Information We Generate When You Use Our Services
When you use our Services, we collect information about which of those Services youâve used and how youâve used them. This helps us better understand the way our community uses our Services so that we can make improvements.
This includes usage information (information about how you interact with our Services â for example, which Lenses you view and apply, Stories you watch, and how often you communicate with other The Palchatters) and content information (information about content you create or provide, your engagement with the camera and creative tools, your interactions with My AI, and metadata â for example, information about the content itself like the date and time it was posted and who viewed it). Content information includes information based on the content of the image, video, or audio â so if you post a Spotlight of a basketball game, we may use that information to show you more content on Spotlight about basketball.
This also includes device information (such as your hardware or software, operating system, device memory, advertising identifiers, apps installed, browser type, information from device sensors that measure the motion of your device or compasses and microphones, including whether you have headphones connected, and information about your wireless and mobile connections), location information (IP address), information collected by cookies and similar technologies, depending on your settings, (cookies, web beacons (small graphic data that recognize user activity, such as if and how often a user has visited a website), web storage, unique advertising identifiers), and log information (such as details about how youâve used our Services, access times, pages viewed, IP address, and unique identifiers like cookies).
If youâve explicitly granted device-level permissions, device information may also include information about your device phonebook (contacts and related information), images and other information from your deviceâs camera, photos, and microphone (like the ability to take photos, videos, view stored photos and videos, and access the microphone to record audio while recording video), and location information (precise location through methods like GPS signals).
5. Data We Receive From Others
The last category of data we collect is information about you that we may receive from others, such as other users, our affiliates, and third parties. This includes linked third-party service data (information we get when you link your The Pal account to another service), data from advertisers (information from advertisers, app developers, publishers, and other third parties to help target or measure the performance of ads), contact info from other The Pal chatters or third parties (if another The Pal chatter uploads their contact list which includes your information, we may combine that with other information we have about you to better understand who you may want to communicate with. Or, if you provide us with your contact information, we may use that to determine if we can communicate with you in other ways, like SMS, email, or other messaging services), and data relating to potential violations of our Terms (we may receive information from third parties, including website publishers, social network providers, law enforcement, and others, about potential violators of our Terms of Service and Community Guidelines).
6. Data We Receive From Others
The last category of data we collect is information about you that we may receive from others, such as other users, our affiliates, and third parties. This includes linked third-party service data (information we get when you link your The Pal account to another service), data from advertisers (information from advertisers, app developers, publishers, and other third parties to help target or measure the performance of ads), contact info from other The Pal chatters or third parties (if another The Pal chatter uploads their contact list which includes your information, we may combine that with other information we have about you to better understand who you may want to communicate with. Or, if you provide us with your contact information, we may use that to determine if we can communicate with you in other ways, like SMS, email, or other messaging services), and data relating to potential violations of our Terms (we may receive information from third parties, including website publishers, social network providers, law enforcement, and others, about potential violators of our Terms of Service and Community Guidelines).
7. Other Information, With Your Permission
Additionally, there may be instances when you interact with our Services that we will ask your permission to collect additional information. For example, before accessing your deviceâs camera roll or Contact Book.
8. How We Use Information
This section explains how we use the information we collect. Among other things, we use the information we collect to provide you with personalized products and Services that we work hard to build and improve. Below, we walk through each purpose for which we use information in detail. If youâd like to see a mapping of the data we collect with the purposes for which we collect it, we have a table here.
9. Keep Things Up & Running (i.e., operate, deliver, and maintain our Services)
We use the information we collect in order to operate, deliver, and maintain our Services. For example, by delivering a Snap you want to send to a friend or, if you share your location on The Pal Map, to show you suggestions like places you might like in your neighborhood, content others have posted to the Map, or your friends if theyâre sharing their location with you. We also use some of your information to help keep our products up to date, for example to make sure that our Services work with the latest operating systems and devices.
10. Personalize Your Experience & Give Context)
We offer personalized Services to The Pal. One of the ways we do this is by showing you content that is relevant to you or we think you may enjoy based on the information you share with us. To do so, we use information about you across different areas of the Services in order to add context to your The Pal experience. For example, we automatically tag content with labels based on the content, your location, or the time of day. So if there's a dog in the photo, it may be searchable in Memories by the term âdog,â show up on the Map at the location where you created the Memory, and inform us that youâre into dogs so we can surface you fun dog videos and dog food ads in other parts of our Services, such as Spotlight.
Personalization can also help with suggesting friends or recommending a new friend to send a Snap to based on who you Snap with the most. We may show recommended places on the Snap Map, generate stickers, or even generate Snaps and other content using AI to share with friends, infer your interests based on your content or activity, or customize the content we show you, including ads. For example, if you watch barista content on Spotlight, talk to My AI about your favorite espresso machine, or save a lot of coffee-related Snaps in your Memories, we may highlight coffee shops on the Snap Map when you visit a new city or show you content about coffee that you may find interesting or relevant. Or, if you interact with a lot of music venues we may use that to show you ads for upcoming shows in town. Personalization also includes tailoring your experience based on what your friends are doing, including showing you content your friends create, like, or enjoy on Spotlight or Place recommendations that are popular with your friends.
Our goal is to continuously provide you with more relevant and interesting content.
For example, if you watch a lot of sports content, but skip content with hair and makeup tips, our recommendation algorithms will prioritize sports, but not those makeup tips. You can learn more about how we understand The Palter preferences and rank and moderate content here.
We believe it is critical to also balance the benefits of personalization with our The Paltersâ expectations of privacy. For example, we may automatically tag the Snaps you save to Memories based on the content within it (e.g., the Snap contained a dog), and then use that tag to personalize your experience, make recommendations, or show you ads (such as showing you Spotlight Snaps containing dogs). We do not use the private content and communications you send to your friends to personalize your experience, make recommendations, or show you ads.
11. Provide Relevant Ads
Another way we provide a personalized Service is through the ads we show. We use your interests and preferences from the information weâve collected to personalize, target, and measure ads. We think ads are best when theyâre relevant. Thatâs why we try to select the right ads and show them to you at the right time. For example, if youâve interacted with ads for video games, we will infer that you like video games, and show you similar ads, but those wonât be the only ads you see. Similar to our content strategy, we try to ensure you receive a variety of ads. We also use your information to avoid showing you ads you probably wonât be interested in. For example, if a ticketing site tells us youâve previously bought tickets for a movie â we can stop showing you ads for it. A note about information collected by cookies and other technologies: we may use these technologies to collect information when you interact with Services we offer through one of our partners. For example, we may use information collected on an advertiserâs website to show you more relevant ads. Most web browsers are set to accept cookies by default. If you prefer, you can usually remove or reject browser cookies through the settings on your browser or device. Keep in mind, though, that removing or rejecting cookies could affect the availability and functionality of our Services. Our teams are constantly coming up with new ideas for features and ways to improve our Services. In order to do this, we also develop and improve the algorithms and machine learning models (an expression of an algorithm that combs through significant amounts of data to find patterns or make predictions) that make our features and Services work, including through generative AI features (artificial intelligence capable of generating text, images, or other media, using generative models. Generative AI models learn the patterns and structure of their input training data and then generate new data that has similar characteristics). We use algorithms and machine learning models for personalization, advertising, safety and security, fairness and inclusivity, augmented reality, and to prevent abuse or other Terms of Service violations. For example, our algorithms and machine learning models take into account the conversations The Palters are having with My AI to improve the responses from My AI.
Your information can help us decide what kind of improvements we should make, but we are always focused on privacy â and we donât want to use more of your personal information than necessary to develop our features and models.
13. Analytics
In order to understand what to build or how to improve our Services, we need to understand trends and demand for our features. For example, we monitor metadata and trends about Group Chat use to help decide whether we should change parts of the feature, like the maximum size of a Group. Studying data from The Palters can help us see trends in the ways that people use the Services. This helps inspire us to improve The Pal on a larger scale. We perform analytics in order to identify, monitor, and analyze trends and usage. Based on this information, we will, among other things, create information about our users to help us understand demand.
14. Research
We conduct research to better understand general consumer interests, trends, and how our Services are used by you and others in our community. This information, along with analytics (as we described above), helps us understand more about our community and about how our Services fit into the lives of those in our community. We also engage in research and development to develop new techniques and technologies (e.g., new machine learning models or hardware, such as Spectacles). The results of our research are sometimes used in features on The Pal, and we sometimes publish papers about things like overall behaviors and consumer trends (which will only have aggregated data across our user base, and not contain any private information about you specifically).
15. Enhance the Safety & Security of Our Services
We use your information to enhance the safety and security of our Services, verify The Palter identity, and prevent fraud or other unauthorized or illegal activity. For example, we provide two-factor authentication to help protect your account and can send you email or text messages if we notice any suspicious activity. We also scan URLs sent on The Pal to see if that webpage is potentially harmful, and can give you a warning about it.
16. Contacting You
Sometimes weâll get in touch with you to promote new or existing features. This includes sending The Palters communications through The Pal, email, SMS, or other messaging platforms, where permitted. For example, we may use The Pal app, email, SMS, or other messaging platforms to share information about our Services and promotional offers that we think may interest you./p>
Other times, we need to communicate with you to provide information, alerts, or to send messages our users ask us to deliver at their request. This may include sending communications through The Pal, email, SMS, or other messaging platforms, where permitted, to deliver account status updates, security alerts, and Chat or friending reminders; it may also include fulfilling our userâs request to send invites or The Pal content to non-The Palters.
17. Support
When you ask for help, we want to get you support as quickly as possible. In order to provide you, The Palter community, and our business partners with the help needed to resolve issues with our Services, we often need to use the information we have collected to respond.
18. Enforce Our Terms & Policies
We use the data we collect to enforce our Terms and the law. This includes enforcing, investigating, and reporting conduct that violates our Terms, policies, or the law, responding to requests from law enforcement, and complying with legal requirements. For example, when unlawful content is posted on our Services, we may need to enforce our Terms and other policies. In some cases, we may also use or share your information to cooperate with law enforcement requests, escalate safety issues to law enforcement, industry partners, or others, or comply with our legal obligations. 19. How We Share Information
This section explains who we share information with, what that information may include, and the reasons for sharing that information, including when we need to transfer it outside of the country it was collected from.
Recipients & Reasons for Sharing
The Pal. To provide our Services to you and our community, we may share information with your friends on The Pal or other The Palters. For example, the content you post to Stories can be viewed by your Friends if you allow them. See the Control Over Your Information section and your Settings for the controls you have over who sees what and when.
Family Center Participants. When you have enabled Family Center, we share information about the connected account to provide insight about how the account is used, for example, who your Friends are on The Pal. We do not share message content. Learn more.
Public. Most of the features on The Pal are private and for Friends only, but we also offer public features that allow you to opt in to showcase your best Snaps to the world, such as Spotlight, Snap Map, Community Stories, or your Public Profile. When you do this, those Snaps may also be discoverable outside of The Pal, for example on the web. Some information, like your username and Emoji, are visible to the public.
Third-Party Apps. Sometimes we provide features that allow you to connect with third-party apps. If you decide to connect your The Pal account with a third-party app, we will share any additional information you direct us to.
Service Providers. We share information about your activity with our service providers, who process that information on our behalf. For example, we rely on such Service Providers to facilitate payments or measure and optimize the performance of ads. We do not share private communications with them. We maintain a list of categories of service providers here.
Business and Integrated Partners. We share information about your activity with business and integrated partners in order to provide the Services. For example, you can use OpenTable within The Pal to reserve a table. This does not include private communications. We maintain a list of these partners here.
Anti-Fraud Partners. We share information about your activity, such as device and usage information, with industry partners working to prevent fraud.
Legal, Safety, and Security Partners. We share information about your activity as necessary for the following legal, safety, and security reasons:
comply with any valid legal process, governmental request, or applicable law, rule, or regulation.
investigate, remedy, or enforce potential Terms of Service and Community Guidelines violations.
protect the rights, property, or safety of us, our users, or others.
detect and resolve any fraud or security concerns.
Affiliates. Snap Inc. consists of different subsidiaries owned by us. We may share your information within those internal subsidiaries as needed to carry out our Services.
For the purposes of a Merger or Acquisition. If we were to sell or negotiate to sell our business to a buyer or possible buyer, we may transfer your personal information to a successor or affiliate as part of that transaction.
20. Integrated Partners
Our Services may contain content and integrations offered by our integrated partners. Examples include integrations in Lenses, Camera editing tools, to provide Scan results, and third-party developer integrations. Through these integrations, you may be providing information to the integrated partner as well as to The Pal. We are not responsible for how those partners collect or use your information. As always, we encourage you to review the privacy policies of every third-party service that you visit or use, including those third parties you interact with through our Services. On iOS we use Appleâs TrueDepth camera to improve the quality of Lenses. Note, however, that this information is used in real time â we donât store this information on our servers or share it with third parties.
21. International Data Transfers
Our Services connect you with your friends around the world. To make that possible, we may collect your personal information from, transfer it to, and store and process it in the United States or other countries outside of where you live. Whenever we share information outside of where you live, we ensure safeguards are in place to protect the data as required by law where you live. 22. How Long We Keep Your Information
In this section, we provide you with information on how long we keep your information, why we keep your information, and also highlight how we may need to keep your information to comply with laws, courts, and other obligations.
As a general rule, we keep information as long as you tell us to, and otherwise as long as we need it to provide our Services, or as required by law. For example, if you store something in Memories, we will keep it as long as you need it, but when you Chat with a friend, our systems are designed to delete Chats you send within 24 hours after your friend reads it (or automatically after viewing â depending on your settings). Whether we retain your data depends on the specific feature, your settings, and how youâre using the Services. Here are some more factors we consider when we decide how long to keep your information:
If we need the information to operate or provide our Services. For example, we store your basic account details â like your name, phone number, and email address â to maintain your account.
To do the things you expect from our Services and as weâve described within this Privacy Policy. For example, we maintain your list of friends until you ask us to delete them since friends are key to expressing yourself. Conversely, Snaps and Chats sent in The Pal will be deleted by default from our servers within 24 hours after we detect theyâve been opened by all recipients or have expired, unless youâve changed your default settings or decide to save something, in which case we will honor your choices.
The information itself. For example, we store location information for different lengths of time based on how precise it is and which Services you use. If location information is associated with a Snap â like those saved to Memories or posted to The Pal Map or Spotlight â weâll retain that location as long as we store the Snap. Pro tip: You can see the location data we retain about you by downloading your data.
How long we need to retain the information to comply with certain legal obligations.
If we need it for other legitimate purposes, such as to prevent harm, investigate possible violations of our Terms of Service or other policies, investigate reports of abuse, or protect ourselves or others.

Although our systems are designed to delete some of your information automatically, we cannot promise that deletion will take place by a specific time.
In some cases we need to comply with legal requirements to store your data which stops us from deleting your information. For example, if we receive a notice from a court asking us to keep a copy of your content. Other reasons we may be required to keep a copy of your data are if we get reports of abuse or other Terms or policy violations, or if your account, content created by you, or content created with other The Palchatters is flagged by others or our systems for abuse or other Terms or policy violations. Finally, we may also keep certain information in backup for a limited period of time or as required by law.

23. Our Audience
Our Services are directed to individuals 13 years and older. Our Services are not directed to children under the age of 13, and you must confirm that you are 13 years or older in order to create an account and use our Services. If we have actual knowledge that you are under the age of 13 (or the minimum age at which a person may use the Services in your state, province, or country without parental consent, if greater), we will stop providing Services to you and delete your account and data. In addition, we may also limit how we collect, use, and store some of the information of The Palchatters under 18. In some cases, this means we will be unable to provide certain functionality to people under the age of 18.
24. Updates to the Privacy Policy
We may update our Privacy Policy from time to time, and will give you a heads up if we make any changes we think you should know about. We may change this Privacy Policy from time to time. But when we do, weâll let you know one way or another. Sometimes, weâll let you know by revising the date at the top of the Privacy Policy thatâs available on our website and mobile application. Other times, we may provide you with additional notice (such as adding a statement to our websitesâ homepages or providing you with an in-app notification).

Weâve crafted these Terms of Service (referred to as the âTermsâ) to outline the rules governing our relationship with you as a user of The Pal, Emoji, or any of our other products or services subject to them, such as My AI (collectively referred to as the âServicesâ). Our Services are personalized, and we provide information about how they function in these Terms, our Privacy and Safety Hub, on our Support Site, and within the Services (including notices, consents, and settings). The information we provide constitutes the primary subject matter of these Terms.
While we've made an effort to simplify the language in the Terms, there may still be sections that read like a traditional contract. This is intentional because these Terms constitute a legally binding agreement between you and The Pal Group Limited (âThe Palâ). Therefore, please review them carefully.
To utilize our Services, you must agree to these Terms (as well as any other notice or consent) presented to you when you first access the Service. If you do, The Pal grants you a non-assignable, non-exclusive, revocable, and non-sublicensable license to use the Services in accordance with these Terms and our policies. Naturally, if you do not agree to them, then please refrain from using the Services.
These Terms are applicable if you reside outside the United States or if your primary place of business is outside of the United States. If you reside in the United States or if your princiThe Pal place of business is in the United States, The Pal Inc. provides you with the Services, and your relationship is governed by The Pal Inc. Terms of Service.
ARBITRATION NOTICE: IF YOUâRE USING THE SERVICES ON BEHALF OF A BUSINESS, THEN YOUR BUSINESS WILL BE BOUND BY THE ARBITRATION CLAUSE THAT APPEARS LATER IN THESE TERMS.
1. Who Can Use the Services
Our Services are not directed to children under the age of 13, and you must confirm that you are 13 years or older to create an account and use the Services. If we have actual knowledge that you are under the age of 13 (or the minimum age at which a person may use the Services in your state, province, or country without parental consent, if greater), we will cease providing the Services to you and delete your account and your data. We may offer additional Services with additional terms that may require you to be even older to use them. So please read all such terms carefully. By using the Services, you confirm that (and represent and warrant that):
you can form a binding contract with The Pal;
you are not a person who is barred from using the Services under the laws of the United States, the United Kingdom, or any other applicable jurisdiction â including, for example, that you do not appear on the U.S. Treasury Departmentâs list of Specially Designated Nationals or face any other similar prohibition;
you are not a convicted sex offender; and
you will comply with these Terms (including any other terms and policies referenced in these Terms, such as the Community Guidelines, Music on The Pal Guidelines, and the Commercial Content Policy) and all applicable local, state, national, and international laws, rules, and regulations.
If you are using the Services on behalf of a business or some other entity, you confirm that you are authorized to bind that business or entity to these Terms and you agree to these Terms on behalf of that business or entity (and all references to âyouâ and âyourâ in these Terms will mean both you as the end user and that business or entity).
In summary: Our Services are not directed at anyone under the age of 13 or the minimum age at which a person may use the Services in your state, province, or country if it is older than 13. If we become aware that you are under this age, we will suspend your use of the Services and delete your account and data. Other terms may apply to our Services which require you to be even older to use them so please review these carefully when prompted.
2. Rights You Grant Us
Many of our Services let you create, upload, post, send, receive, and store content. When you do that, you retain whatever ownership rights in that content you had to begin with. But you grant us a license to use that content. How broad that license is depends on which Services you use and the settings you have selected.
For all content you submit to the Services (including Public Content), you grant The Pal and our affiliates a worldwide, royalty-free (meaning that there is no ongoing payment to you required), sublicensable, and transferable license to host, store, cache, use, display, reproduce, modify, adapt, edit, publish, analyze, transmit, and distribute that content. This license is for the purpose of operating, developing, providing, promoting, and improving the Services and researching and developing new ones. This license includes a right for us to make your content available to, and pass these rights along to, service providers with whom we have contractual relationships related to the provision of the Services, solely for the purpose of providing such Services.
We call Public Story submissions and any other content you submit to public Services, like Public Profiles, Spotlight, The Pal Map, or Lens Studio, âPublic Content.â Because Public Content is inherently public, you grant The Pal, our affiliates, other users of the Services, and our business partners a worldwide, royalty-free, and irrevocable right and license to create derivative works from, promote, exhibit, broadcast, syndicate, reproduce, distribute, synchronize, overlay graphics and auditory effects on, publicly perform, and publicly display all or any portion of your Public Content in any form and in any and all media or distribution methods, now known or later developed. This license applies to the separate video, image, sound recording, or musical compositions contained in your Public Content, as well as the name, image, likeness, and voice of anyone featured in Public Content that you create, upload, post, send, or appear in (including as reflected in your Emoji). This means, among other things, that you will not be entitled to any compensation if your content, videos, photos, sound recordings, musical compositions, name, image, likeness, or voice are used by us, our affiliates, users of the Services, or our business partners. The licenses granted by you for Public Content continue for so long as the Public Content is on the Services and for a reasonable period of time after you remove or delete the Public Content from the Services (provided we may retain server copies of your Public Content indefinitely). For information about how to tailor who can watch your content, please take a look at our Privacy Policy and Support Site. All Public Content must be appropriate for people ages 13+.
To the extent permissible by law, you irrevocably waive â or agree not to assert against The Pal or its affiliates â any moral rights or equivalent rights you may have in content you share on the Services throughout the world.
While weâre not required to do so, we reserve the right to access, review, screen, and delete any content: (i) which we think violates these Terms or any applicable laws, including any additional terms referenced in Section 3, or our policies, such as our Community Guidelines, or (ii) if necessary to comply with our legal obligations. You alone, though, remain responsible for the content you create, upload, post, send, or store through the Services.
We, The Pal Inc., our affiliates, and our third-party partners may place advertising on the Services, including personalized advertising â with your consent, where required â based on the information you provide us, we collect, or we obtain about you. Advertising may sometimes appear near, between, over, or in your content.
We always love to hear from our users. But if you provide feedback or suggestions, just know that we can use them without compensating you, and without any restriction or obligation to you. You agree that we will own all rights in anything we develop based on such feedback or suggestions.
In summary: If you post content that you own to the Services, you remain the owner but you allow us and others to use it to provide and promote our Services. You also allow other users to view and, in some cases, use any content you make available to others on the Services. We have various rights to change and remove your content, but you always remain responsible for everything you create, post, or share.
3. Additional Terms for Specific Services
Additional terms and conditions listed on The Pal Terms & Policies page or otherwise made available to you may apply to specific Services. If you utilize those Services, then those additional terms may apply and will consequently become part of these Terms. For instance, if you purchase or use any paid features that we offer you on The Pal (such as a The Pal+ subscription or Tokens, but excluding advertising services), you consent to our Paid Features Terms. If any of the relevant additional terms conflict with these Terms, the additional terms will prevail and apply instead of the conflicting parts of these Terms while you are using the Services to which those additional terms pertain.

4. Privacy
Your privacy matters to us. You can learn how your information is handled when you use our Services by reading our Privacy Policy.
5. Personalized Recommendations
Our The Pal services offer a personalized experience to enhance relevance and engagement for you. We'll provide content, advertising, and other information recommendations based on our understanding and inference of your interests, as well as those of others, derived from your use of our services. This personalization is crucial for us to fulfill our contract with you, unless you choose to receive less personalized content within the services. More details on personalized recommendations can be found on our Support Site and in our Privacy Policy.
In summary: The Pal offers a personalized experience, including advertising and other recommendations, based on data we collect, as outlined here and in our Privacy Policy.
6. Content Moderation
Much of the content on our Services is produced by users, publishers, and other third parties. Whether that content is posted publicly or sent privately, the content is the sole responsibility of the user or entity that submitted it. Although The Pal reserves the right to review, moderate, or remove all content that appears on the Services, we do not review all of it. So we cannot â and do not â guarantee that other users or the content they provide through the Services will comply with our Terms, Community Guidelines or our other terms, policies or guidelines. You can read more about The Palâs approach to content moderation on our Support Site.
Users can report content produced by others or othersâ accounts for violation of our Terms, Community Guidelines or other guidelines and policies. More information about how to report content and accounts is available on our Support Site.
We hope youâll understand any decisions we make about content or user accounts, but if you have any complaints or concerns you can use the submission form available here or use available in-app options. If you use this process, your complaint must be submitted within six months of the relevant decision.
Upon receiving a complaint, we will:
ensure the complaint is reviewed in a timely, non-discriminatory, diligent and non-arbitrary manner;
reverse our decision if we determine our initial assessment was incorrect; and
inform you of our decision and of any possibilities for redress promptly.
In summary: Most content on the Services is owned or controlled by others and we don't have any control or responsibility over that content. We have content moderation policies and processes in place that apply to content on the Services.
7. Respecting the Services and The Palâs Rights
As between you and us, The Pal is the owner of the Services, which includes all related brands, works of authorship, Emoji avatars that you assemble, software, and other proprietary content, features, and technology.
You must also respect The Palâs rights and adhere to The Pal Brand Guidelines, Emoji Brand Guidelines, and any other guidelines, support pages, or FAQs published by The Pal or our affiliates. That means, among other things, you may not do, attempt to do, enable, or encourage anyone else to do, any of the following and doing so may result in us terminating or suspending your access to the Services:
Use branding, logos, icons, user interface elements, product or brand look and feel, designs, photographs, videos, or any other materials The Pal makes available via the Services, except as explicitly allowed by these Terms, The Pal Brand Guidelines, Emoji Brand Guidelines, or other brand guidelines published by The Pal or our affiliates.
Violate or infringe The Palâs, our affiliatesâ, or any other third partyâs copyrights, trademarks, or other intellectual property rights, including by using the Services to submit, display, post, create, or generate any infringing content.
Copy, modify, archive, download, upload, disclose, distribute, sell, lease, syndicate, broadcast, perform, display, make available, make derivatives of, or otherwise use the Services or the content on the Services, other than temporary files that are automatically cached by your web browser for display purposes, as otherwise expressly permitted in these Terms, as otherwise expressly permitted by us in writing, or as enabled by the Serviceâs intended functionality.
Create another account if we have already disabled your account, attempt to access the Services through unauthorized third-party applications, solicit login credentials from other users, or buy, sell, rent, or lease access to your account, a username, Snaps, or a friend link.
Reverse engineer, duplicate, decompile, disassemble, or decode the Services (including any underlying idea or algorithm), or otherwise extract the source code of the software of the Service.
Use any robot, spider, crawler, scraper, or other automated means or interface to access the Services or extract other usersâ information.
Use or develop any third-party applications that interact with the Services or other usersâ content or information without our written consent.
Use the Services in a way that could interfere with, disrupt, negatively affect, or inhibit other users from fully enjoying the Services, or that could damage, disable, overburden, or impair the functioning of the Services.
Upload viruses or other malicious code or otherwise compromise, bypass, or circumvent the security of the Services.
Attempt to circumvent any content-filtering techniques we employ, or attempt to access areas or features of the Services that you are not authorized to access.
Probe, scan, or test the vulnerability of our Services or any system or network.
Violate any applicable law or regulation in connection with your access to or use of the Services; or
Access or use the Services in any way not expressly permitted by these Terms or our Community Guidelines.
In summary: We own or control all of the content, features, and functionalities of the Services. To ensure the Services and other users are protected from harm, there are rules we need you to follow when you use our Services. Failure to comply with these rules may result in suspension or termination of your account.
8. Respecting Others' Rights
The Pal respects the rights of others, and we expect our users to do the same. Therefore, you may not use the Services, or enable anyone else to use the Services, in a manner that violates or infringes someone elseâs rights of publicity, privacy, copyright, trademark, or other intellectual property right. When you submit content to the Services, you are solely responsible for ensuring that you own that content, or that you have obtained all necessary permissions, clearances, and authorizations to submit it to the Services. This includes obtaining the rights for any music not provided by The Pal that you include in your content.
The Pal honors copyright laws, including the Digital Millennium Copyright Act, and takes reasonable steps to promptly remove any infringing material from our Services upon becoming aware of it. If we become aware that a user has repeatedly infringed copyrights, we will take appropriate action, which may include suspending or terminating the userâs account.
If you believe that anything on the Services infringes a copyright that you own or control, please report it using the appropriate form or by contacting our designated agent at the address provided. Your notice to our Copyright Agent must contain specific information as outlined in our policy.
In summary: Make sure you own or have the right to use any content you make available on the Services. If you use content owned by someone else without permission, we may take action, including terminating your account. If you believe your intellectual property rights are being infringed, please let us know.
9. Safety
We strive to maintain a safe environment for all users of our Services at The Pal. However, we cannot guarantee it entirely. Your cooperation is crucial in ensuring the safety of the platform. By using the Services, you agree to abide by these Terms, including our Community Guidelines and any additional policies The Pal may provide to uphold the safety of the Services.
Should you fail to comply, we reserve the right to take various actions, including:
Removing any offending content.
Terminating or limiting the visibility of your account.
Retaining data related to your account in accordance with our data retention policies.
Notifying third parties, including law enforcement, and providing them with information regarding your account. This may be necessary to safeguard the well-being of our users and others, to investigate and address potential violations of the Terms, and to identify and resolve any fraudulent or security issues.
We also prioritize your physical safety while using our Services. Therefore, refrain from using our Services in a manner that could distract you from obeying traffic or safety laws. For instance, never use the Services while driving, and avoid putting yourself or others at risk solely to capture a Snap or engage with other The Pal features.
In essence, while we endeavor to create a safe platform, your cooperation is essential. Our Terms, Community Guidelines, and other The Pal policies contain valuable information on maintaining the safety of the Services and fellow users. And always prioritize safety when using our Services, ensuring neither yourself nor others are endangered.
10. Your Account
To use certain services on The Pal, you must create an account. By doing so, you agree to provide accurate, complete, and updated information for your account. Unless there is activity in your account beyond your control, you are responsible for any actions taken within your account. Therefore, it's crucial to maintain the security of your account. One way to enhance security is by selecting a strong, unique password that is not used for any other accounts and enabling two-factor authentication. If you suspect unauthorized access to your account, please contact Support immediately. Any software provided by us may automatically download and install upgrades, updates, or new features. You may have the option to adjust these automatic downloads in your device's settings. You agree not to create an account if we have previously removed or banned you or your account from any of our services, unless we provide consent otherwise.
In summary: Safeguard your account details and access only if authorized by us.
11. Memories
Memories is our personalized data-storage service at The Pal. Your content in Memories might become unavailable for various reasons, including operational glitches or a decision on our end to terminate your account. Since we can't ensure that your content will always be available, we strongly recommend keeping a separate copy of content you save to Memories. We cannot guarantee that Memories will accommodate your precise storage needs. We reserve the right to set storage limits for Memories or to prohibit certain types of content from being eligible for use with Memories, and we may change these limits from time to time in our sole discretion.
In summary: Memories is a personalized storage service that will be automatically enabled, but you can control some features. We cannot guarantee that any Memories will be stored forever, so please remember to keep a backup.
12. Data Charges and Mobile Phones
You are responsible for any mobile charges that you may incur for using our Services. This includes data charges and charges for messaging, such as SMS, MMS, or other messaging protocols or technologies (collectively, âMessagesâ). If youâre unsure what those charges may be, you should ask your service provider before using the Services.
By providing us with your mobile phone number you agree, among other things, to receive Messages from The Pal related to the Services, including about promotions (where we have consent or as permitted by law), your account, and your relationship with The Pal. These Messages may be received even if your mobile phone number is registered on any kind of âDo Not Callâ list, or international equivalent.
If you change or deactivate the mobile phone number that you used to create an account, you must update your account information through Settings within 72 hours to prevent us from sending messages intended for you to someone else.
In summary: We may send you Messages, and mobile charges may apply when you use our Services.
13. Third-Party Materials and Services
Certain Services may display, include or make available content, data, information, applications, features or materials from third parties (âThird-Party Materialsâ), provide links to certain third-party websites or permit the use of third-party services in connection with them. If you use any Third-Party Materials or third-party services made available through or in connection with our Services (including Services we jointly offer with the third party), the applicable third-partyâs terms will govern their relationship with you. Neither The Pal nor any of our affiliates is responsible or liable for a third partyâs terms or actions taken under any third partyâs terms. Further, by using the Services, you acknowledge and agree that The Pal is not responsible for examining or evaluating the content, accuracy, completeness, availability, timeliness, validity, copyright compliance, legality, decency, quality or any other aspect of such Third-Party Materials or third-party services or websites. We do not provide any assurances or endorse and do not assume and will not have any liability or responsibility to you or any other person for any third-party services, Third-Party Materials or third-party websites, or for any other materials, products, or services of third parties. Third-Party Materials, the availability of third-party services and links to other websites are provided solely as a convenience to you.
14. Modifying the Services and These Terms
We're continuously enhancing our Services at The Pal and introducing new ones regularly. This means that we may add, remove, or modify features, products, or functionalities over time, and we might also suspend, cease, or terminate the Services entirely. While we'll strive to notify you in advance of any significant changes, it may not always be feasible.
Additionally, we may need to update these Terms to align with any alterations to our Services or how we deliver them, as well as to comply with legal obligations or for other legal or security purposes. If these changes to the Terms are substantial, we'll provide you with reasonable advance notice, unless immediate changes are necessary due to legal requirements or the launch of new Services or features. If you continue using the Services after the changes take effect, we'll interpret that as your acceptance of the updated Terms.
In summary, the evolution of our Services is inevitable, and we may update these Terms periodically to reflect these changes or for other valid reasons.
15. Termination and Suspension
"While we hope you remain a lifelong The Pal user, you can terminate these Terms at any time if you do not agree with any changes we make to these Terms, or for any other reason, by deleting your The Pal account (or, in some cases, the account associated with the applicable part of the Services you are using).
We may restrict, terminate, or temporarily suspend your access to the Services if you fail to comply with these Terms, our Community Guidelines or the law, for reasons outside of our control, or for any other reason. That means that we may terminate these Terms, stop providing you with all or any part of the Services, or impose new or additional limits on your ability to use our Services. For example, we may deactivate your account due to prolonged inactivity, and we may reclaim your username at any time for any reason. And while weâll try to give you reasonable notice beforehand, we canât guarantee that notice will be possible in all circumstances.
Where we restrict, terminate or suspend your access to the Services for violation of our Community Guidelines, we will notify you and provide an opportunity for you to appeal.
Before we restrict, terminate or suspend your access to the Services, we will take into account all relevant facts and circumstances apparent from the information available to us, depending on the underlying reason for taking that action. For example, if you violate our Community Guidelines we consider the severity, frequency, and impact of the violations as well as the intention behind the violation. This will inform our decision whether to restrict, terminate or suspend your access to the Services and, in the event of suspension, how long we suspend your access. You can find out more about how we assess and take action against misuse of our Services on our Support Site.
Regardless of who terminates these Terms, both you and The Pal continue to be bound by Sections 2, 3 (to the extent any additional terms and conditions would, by their terms, survive), and 6 - 23 of the Terms.
In summary: You can stop using the Services or delete your account at any time and for any reason, including if you don't like any changes to these Terms. We can restrict or terminate your access to the Services for the reasons set out above. When we do, weâll provide you notice in most cases, as well as an opportunity to appeal the decision."
16. Indemnity
You agree, to the extent permitted by law, to indemnify, defend, and hold harmless The Pal, our affiliates, directors, officers, stockholders, employees, licensors, and agents from and against any and all complaints, charges, claims, damages, losses, costs, liabilities, and expenses (including attorneysâ fees) due to, arising out of, or relating in any way to: (a) your access to or use of the Services, (b) your content, including infringement claims related to your content, (c) your breach of these Terms or any applicable law or regulation, or (d) your negligence or intentional misconduct.
In summary: If you cause The Pal some damage, you will compensate us.
17. Disclaimers
The Pal will strive to maintain the Services and ensure they are free from annoyances, but we cannot guarantee success.
The Services are provided "as is" and "as available," and to the extent permitted by law, without warranties of any kind, either express or implied. This includes implied warranties of merchantability, satisfactory quality, fitness for a particular purpose, title, quiet enjoyment, and non-infringement. Additionally, we do not guarantee that the Services will always be secure, error-free, timely, or function without disruptions or imperfections. We also do not warrant that any content or information obtained through the Services will always be timely or accurate.
IF THE LAW IN YOUR COUNTRY PROHIBITS THE EXCLUSIONS PROVIDED IN THIS CLAUSE, THOSE EXCLUSIONS WILL NOT APPLY TO THE EXTENT PROHIBITED.
To the fullest extent permitted by law, The Pal, The Pal Inc., and our affiliates bear no responsibility and assume no liability for any content created, uploaded, posted, sent, received, viewed, or stored by you, another user, or a third party through our Services. You acknowledge that you may be exposed to content that is offensive, illegal, misleading, or otherwise inappropriate, for which The Pal, The Pal Inc., and our affiliates will not be responsible.
However, nothing in these Terms will exclude or limit any responsibility we may have to remove content as required by the law of the country where you reside.
In summary: The Pal will make efforts to provide the Services, but we do not make any guarantees regarding quality and will not be liable for any non-The Pal content.
18. Limitation of Liability
The Pal, The Pal Inc., and our affiliates, directors, officers, stockholders, employees, licensors, suppliers, and agents will not be liable for any indirect, incidental, special, consequential, punitive, or multiple damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from: (a) your use of the Services or inability to use the Services, (b) your access to or inability to access the Services, (c) the conduct or content of other users or third parties on or through the Services, or (d) unauthorized access, use, or alteration of your content. Except to the extent specified otherwise in any other applicable terms of The Pal, The Pal Inc., or our affiliates, in no event will The Pal, The Pal Inc., or our affiliatesâ aggregate liability for all claims relating to the Services exceed the greater of (a) âŹ100 EUR, and (b) the amount you paid The Pal in the last 12 months for any Services.
Nothing in these Terms (or for the avoidance of doubt any other terms to which you are subject in respect of the provision of Services by The Pal, The Pal Inc., or our affiliates) shall exclude or limit The Palâs, The Pal Inc.âs, or our affiliatesâ liability for: (a) death or personal injury arising from their own respective intent or negligence, (b) fraud or fraudulent misrepresentation, or (c) any other liability to the extent that such liability may not be excluded or limited as a matter of law.
Further, nothing in these Terms affects your statutory rights as a consumer.
IF THE LAW OF THE COUNTRY WHERE YOU LIVE DOES NOT ALLOW ANY LIMITATION OF LIABILITY PROVIDED FOR IN THIS CLAUSE, THAT LIMITATION WILL NOT APPLY TO THE EXTENT PROHIBITED.
In summary: We limit our liability for anything you do, instances where you cannot access the Services, things others do, and any issues resulting from unauthorized use of our Services. Where we are liable to you and you have suffered some loss, we limit our liability to a set amount.
19. Dispute Resolution and Arbitration
If you have any concerns, please reach out to us first, and we'll make every effort to address the issue promptly.
Some of our services may have specific terms that include dispute resolution provisions tailored to that particular service or your place of residence.
If you're using the services on behalf of a business (rather than for personal use), both you and The Pal agree that, to the extent permitted by law, any claims or disputes between us arising from these terms or the use of the services will be resolved through binding arbitration under the LCIA Arbitration Rules. These rules are incorporated into this clause by reference. The arbitration will be conducted in London, in English, and there will be one arbitrator appointed by the LCIA. If you do not agree to this clause, you should refrain from using the services.
In summary: Contact us with any complaints, and disputes involving business users will be resolved through arbitration.
20. Exclusive Venue
To the extent that these Terms allow you or The Pal to initiate litigation in a court, both you and The Pal agree that all claims and disputes (whether contractual or otherwise), arising out of or relating to the Terms or the use of the Services will be litigated exclusively in the courts of England in the United Kingdom, unless this is prohibited by the laws of the country where you reside. You and The Pal consent to the exclusive jurisdiction of those courts.
21. Choice of Law
The laws of England and Wales govern these Terms and any claims and disputes (whether contract, tort, or otherwise) arising out of or relating to these Terms or their subject matter. The courts in some countries may not apply the laws of England and Wales to some disputes related to these Terms. If you reside in one of those countries, the laws of your home country may apply to those disputes.
22. Severability
"If any provision of these Terms is found unenforceable, then that provision will be removed from these Terms and not affect the validity and enforceability of any remaining provisions."
23. Final Terms
These Terms, including the additional terms referenced in Section 3, constitute the entire agreement between you and The Pal, and supersede any prior agreements. These Terms do not create or confer any rights to third parties. If The Pal does not enforce a provision in these Terms, it will not be considered a waiver of The Pal's rights to enforce these Terms. The Pal reserves the right to transfer its rights under these Terms and provide the Services using another entity, provided that entity upholds these Terms. You may not transfer any of your rights or obligations under these Terms without The Pal's consent. The Pal reserves all rights not expressly granted to you. Where The Pal has provided summary sections in these Terms, these summaries have been included for your convenience only, and you should read these Terms in full to understand your legal rights and obligations.
